Article 1- General dispositions relating to the General Terms and Conditions of Sale (hereinafter “GTC”)
1. 1. Purpose
The GTC are applicable exclusively to the online sale of products appearing on the site www.bodhihemps.com, access to which is free and open to all Internet users.
1. 2. Scope
The GTC exclusively govern the online sales contracts of BODHI HEMP’S SASU products to customers and constituting with the online order the contractual documents enforceable against the parties, to the exclusion of all other documents, prospectuses, catalogs or photographs of the products that are not ‘have only an indicative value.
The GTC are exclusively applicable to products delivered to customers established in mainland France, in overseas territories, and / or in a member country of the EU and the European economic area. The Terms and Conditions are drawn up, as well as all the contractual information mentioned on the site, in French, English and Spanish.
The sale of products presented on the site www.bodhihemps.com is strictly prohibited to any minor under the age of 18. In accordance with European regulations, the analyzes carried out were carried out using the so-called “gas chromatography coupled with mass spectrography” method.

Under no circumstances can Bodhi Hemp’s SASU be held responsible in the event of a dispute.
1. 3. Availability and enforceability of the GTC
The GTC are made available to consumers on the seller’s site where they can be viewed directly. The GTC are enforceable against the customer who acknowledges, by ticking a box provided for this purpose, to have read and accepted them before confirming the order. The validation of the order by its confirmation implies acceptance by the customer of the GTC in force on the day of the order, the conservation and reproduction of which are ensured by the professional seller in accordance with article 1127-2 of the civil code (former C. civ ., art. 1369-4).
1. 4. Modification of the GTC
BODHI HEMP’S SASU reserves the right to modify its T & Cs at any time. In the event of modification of the GTC, the applicable GTC are those in force on the date of the order, a copy of which dated to date can be given to the customer at his request.
1. 5. Divisibility of the clauses of the GTC
The nullity of a contractual clause does not entail the nullity of the GTC, unless it is an impulsive and decisive clause which led one of the parties to conclude the sales contract. The temporary or permanent non-application of one or more clauses of the GTC by BODHI HEMP’S SASU shall not constitute a waiver on its part of the other clauses of the GTC which continue to produce their effects.
Article 2 – Products
The products offered for sale presented in the catalog published on the site are each the subject of a description mentioning their essential characteristics within the meaning of Article L. 111-1 of the French Consumer Code.
The photographs illustrating the products do not constitute a contractual document.
The method of use of the product, if it is an essential element, is mentioned in the electronic catalog or at the latest on delivery.
The products are offered and delivered within the limits of available stocks.
In case of unavailability of the ordered product, BODHI HEMP’S SASU offers the customer either:
- to send a substitute product with similar characteristics, the price of which is at least equal to that of the product initially chosen;
- to edit a voucher of the order value;
- to refund the order within 7 days.
Apart from the refund of the unavailable product, BODHI HEMP’S SASU is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to it.
Article 3 – Price
The selling prices are indicated, for each of the products appearing in the website, in euros all taxes included, excluding delivery and transport costs.
The selling price of the product is the price at the day of purchase.
The delivery and transport costs are mentioned before validation of the order and invoiced in addition except when the order exceeds a sum previously announced on the page “Delivery and payment” of the site www.bodhihemps.com.
They are fixed when the order is confirmed.
The total amount owed by the customer is indicated on the order confirmation page.
In the event of a price promotion, BODHI HEMP’S SASU undertakes to apply the promotional price to any order placed during the advertising period for the promotion.
BODHI HEMP’S SASU reserves the right to modify its prices at any time, while guaranteeing to the customer the application of the price in force on the day of the order.
Article 4 – Offer
The online sales offers presented on the site are reserved for customers residing in metropolitan France / overseas territories and / or in a member country of the European Union and for deliveries in these same geographical areas.
The online sales offers presented on the site are valid, in the absence of a specific duration indication, as long as the products appear in the electronic catalog and within the limits of available stocks.
The acceptance of the offer by the customer is validated, in accordance with the double click process, by the confirmation of the order.

Article 5 – Customer Account
Before placing an order on the site, the Customer can create a customer account. To this end, he must complete a form in the “My Account” section with information concerning him, and he undertakes to provide accurate information and not to usurp the identity of a third party or to change his age.

Article 6 – Order
6. 1. Stages of conclusion of the contract
To place an order, the customer, after having filled his virtual basket by indicating the selected products and the desired quantities, then clicks on the button “Validate the basket” and provides the information relating to the delivery and the method of payment.
Before clicking on the button to validate the cart, the customer has the possibility to check the details of his order and its total price and to return to the previous pages to correct any errors or possibly modify his order.
The sales contract is formed when the customer sends the confirmation of his order.
6. 2. Order modification
Any modification of the order by the customer after confirmation of his order is subject to acceptance by the professional seller.
6.3. Order confirmation
An email acknowledging receipt of the order and its payment will be sent by BODHI HEMP’S SASU as soon as possible.
BODHI HEMP’S SASU reserves the right to refuse any order for legitimate reasons and more particularly if the quantities of products ordered are abnormally high for customers having the status of individuals.
6.4. Archiving
The archiving of communications, purchase orders and invoices is carried out on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with Article 1360 of the French Civil Code. These communications, purchase orders and invoices can be produced as proof of the contract.
Article 7 – Payment
The price of the products is payable in full after confirmation of the order.
7.1 Payment terms
Payment is made online by credit card or bank transfer.
7.2. Secure payment

7.3. Default of payment
In the event of failure to pay the full price within ten days, the contract will be deemed to be terminated automatically.
Article 8 – Delivery
8. 1. Delivery area
BODHI HEMP’S SASU delivers all orders to mainland France, overseas territories and European Union territory.
8.2. Delivery delay
BODHI HEMP’S SASU undertakes to deliver the products within the period indicated on the order validation page by the customer, namely:
From 24 hours to 5 days in mainland France;
From 3 days to 10 days in European Union countries;
5 to 20 days in the overseas territories.
The delivery time corresponds to the shipping time indicated on the product page to which is added the processing and delivery time.
The period starts from the total payment of the order.
The deadlines do not apply in cases of force majeure or fortuitous event.
8. 3. Shipping costs
Delivery costs are the responsibility of the customer, except when the order exceeds a previously determined amount.
8.4. Terms of delivery
The products are delivered to the address indicated by the customer on the order form.
Delivery is made by:
- direct delivery of the product to the customer by carriers depending on the size of the object;
- by home delivery;
- by collection at a relay point.
If the package is made available, it must be collected by the customer within fifteen days of the notice of availability.
In the absence of withdrawal by the customer within the period indicated, BODHI HEMP’S SASU may, after a formal notice from the customer has remained ineffective, return the package and automatically resolve the order. Delivery costs will not be refunded, and any return costs will be charged to the customer.
8.5. Product conformity
When the product is delivered to the address indicated, it is the customer’s responsibility to check the condition of the product delivered in the presence of the delivery person and, if applicable, to make comments on the delivery slip or on the transport receipt.
If the product does not comply with the order, the customer must send a complaint to the professional seller with a view to obtaining the replacement of the product or possibly the resolution of the sale.
8.6. Delivery and transfer of risk
The product, which is delivered to the customer by a carrier chosen by BODHI HEMP’S SASU, travels at the risk and peril of the seller. The risk is transferred to the buyer when he takes physical possession of the goods.
The risks of loss or damage to the goods are transferred to the customer when he takes, or a third party he has designated, physically possession of the goods, without distinction according to its nature.
8.8. Transfer of ownership
When delivery is done, ownership of the product passes to the customer.
8.9. Late delivery
If delivery has not been made within 30 days of the date of the online order, the customer may request a refund within 30 days.
This period does not apply in the event of force majeure.
8.10. Delivery fail
Total failure to deliver results in the automatic termination of the sales contract and reimbursement of the price paid, including delivery costs.
A delivery incident will not be considered as a delivery failure.
Article 9 – Legal guarantee of conformity and guarantee against hidden defects
All products supplied by BODHI HEMP’S SASU benefit from the legal guarantee of conformity provided for in Articles L. 217-4 and following of the French Consumer Code or from the guarantee against hidden defects provided for in Articles 1641 and following of the French Civil Code.
The French law applicable to the contract may not have the effect of depriving the customer residing in another Member State of the provisions on the guarantees granted to him by his national law in application of the directive of 25 May 1999 concerning the sale and guarantees of goods of consumption.
BODHI HEMP’S SASU is bound by the guarantee due to hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the customer has not acquired it, or does not would have given a lower price, if he had known them.
The customer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code. In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the French civil code.
Article 10 – Right of withdrawal and return of ordered items
In accordance with Articles L. 221-5 et seq. Of the French Consumer Code and the UE Reglementation, the customer has a period of 14 days from delivery, by himself or a third party, of the items ordered to exercise his right of withdrawal without having to justify reasons or pay penalties.
To exercise the right of withdrawal, the customer must contact us via the form in French available on the following page https://bodhihemps.com/fr/contact-us/ (in English: https://bodhihemps.com/contact- us /; in Spanish: https://bodhihemps.com/es/contact-us/) or send an email containing his name, first name, address and order number and unambiguously indicating that he is exercising his right of withdrawal to the following address: info @ bodhihemps.com.
The cost of returning the product ordered and delivered to the customer will be borne by the customer.
Returned products must be new, unused, and if applicable in their original box. Any returned item soiled and / or damaged by the customer will not be taken back.
The return is made after reception and confirmation of the request by BODHI HEMP’S SASU.
It is up to the customer to provide proof of this return.
The Customer will be refunded for the entirety of his order, at the invoiced price, with the exception of delivery costs, within 15 days of reception by BODHI HEMP’S SASU of the returned order. This refund will be made on the same payment method as that used for the initial transaction.
If the return is refused by BODHI HEMP’S SASU for the reasons set out above, the products will then be returned to the customer at his expense without the possibility to request any compensation or right to reimbursement, with the exception of the subsequent exercise of its warranty rights on the products sold.
Article 11 – Complaints

Article 12 – Intellectual propriety
The content of the site www.bodhihemps.com, the general structure as well as the software, texts, animated or not images, photographs, its know-how and all the other elements composing the site are the exclusive property of the company BODHI HEMP’S SASU or of its partners who have granted it a license.
Any total or partial representation of this site by any person whatsoever without the express authorization of the company BODHI HEMP’S SASU is prohibited and constitutes an infringement punishable by the Intellectual Property Code.
The distinctive signs of BODHI HEMP’S SASU and its partners, such as domain names, brands, names and logos appearing on the site are protected by the Intellectual Property Code.
Any total or partial reproduction of these distinctive signs made from elements of the site without the express authorization of the company BODHI HEMP’S SASU is therefore prohibited.
Article 13 – Force majeure
In the event of force majeure as defined by current case law, the performance of BODHI HEMP’s SASU services will be suspended for all or part. Force majeure means any external, unforeseeable and insurmountable event preventing BODHI HEMP’S SASU from performing its contractual obligations.
In the event of the occurrence of an event qualified as force majeure according to the previous paragraph, BODHI HEMP’S SASU undertakes to notify the customer as soon as possible.
Article 14 – Disputes, competent court and applicable law
This contract and the GTC governing it are subject to French law, subject to the mandatory rules of the consumer’s country of residence.
In the absence of an amicable agreement, any dispute relating to the existence, interpretation, conclusion, execution or termination of the contract as well as all documents related to this contract fall within the jurisdiction of the court and / or of the Nantes Commercial Court, Loire Atlantique, France.
